Data Privacy Information for Study Feedback Surveys
You have participated in a clinical study sponsored by Bayer. Now you are being asked to share your experience using an online survey. With this Data Privacy Statement ("Statement"), Bayer AG, Kaiser-Wilhelm-Allee 1, 51373 Leverkusen, Germany, explains how your Personal Data is processed for this purpose. Personal Data is any information relating to an identified or identifiable natural person. Personal Data is protected by applicable data privacy laws, such as, but not limited to, the EU General Data Protection Regulation (EU) 2016/679 (“GDPR”).
Your responses to the online survey will be handled in an anonymous way. This means that Bayer will not know who you are, and your questions will not be linked to any information that identifies you.
However, when you call up the online survey, your browser will transfer certain data to the survey web server. This is done for technical reasons and required to make available the survey to you. The following information are collected, briefly stored, and used:
IP address
Date and time of access
Time zone
Country
Browser, language (to load the language version of our site that matches your language setting) and browser software version
The data is processed to make available the functionalities of the survey website once to you once you request to open the website (Art. 6(1)(b) General Data Protection Regulation). Accessing the survey website is completely voluntary. There are no disadvantages to you if you do not access the survey website.
The data is not retained beyond the time of answering the survey. Once you submit your answers, they will be anonymized.
The survey website uses so-called “cookies”. Cookies are small text files that are stored in the memory of your terminal via your browser. No optional cookies are used, no website analytics, website personalization or marketing purposes are implemented.
The survey website is hosted by Qualtrics LLC, 333 W River Park Drive, Provo, Utah 84604, USA. Bayer has agreed a data privacy contract with Qualtrics for processing of Personal Data on Bayer’s behalf. This includes the so-called standard contractual clauses adopted by the European Commission as appropriate for transfers to countries for which the European Commission has not determined an appropriate data protection level.. A copy of the standard contractual clauses can be provided on request.
Applicable data privacy laws ensure that you have certain privacy rights. These rights may include the following:
Request information about Personal Data processed by or on behalf of Bayer.
Request the correction of Personal Data if these are incorrect or incomplete.
Request the deletion of Personal Data, e.g., if these are no longer necessary for the purposes for which they have been collected or processed, or if there is no legal basis for their further processing.
Request the restriction of the processing, e.g., if the accuracy of Personal Data is contested, or the processing is unlawful.
Request the transfer of Personal Data in a commonly utilizable format to the requestor or another controller, e.g., if the processing is based on a consent.
Object to the processing of Personal Data as far as such processing is based on Bayer’s legitimate interest.
Withdraw any consent to processing of Personal Data that the requestor may have given. Withdrawing a consent does not affect the lawfulness of processing before consent withdrawal.
File a complaint with a data protection authority.
